The Property
Silver Harbour Estates consists of a total of 29 residential building
units (lots), all fronting on Lake Superior. All of the units (lots) will be serviced with hydro,
telephone, and natural gas to the property owner’s lot line. The road servicing the individual
units (lots) will meet or surpass the standards and regulations of the Township of
Shuniah. Units (lots) #1 to #24 have the Superior view, and units (lots) #25 to #29
are in the sheltered McKenzie Bay area.
Development Guidelines
These guidelines are an important mechanism to assure a high level
of quality design, construction, and landscaping for the
subdivision. Buildings on the site are to appear as part of the
natural landscaping rather than to visually dominate the site.

Disclosures for Purchasers (Current
& Prospective) of Units (lots) in Silver Harbour Estates Development
Sewage Disposal
1. Importation of suitable fill may be required to construct
subsurface sewage disposal systems to the satisfaction of the Thunder
Bay District Health Unit.
2. A qualified consultant is required to prepare the final design
of each and every sewage treatment system to the satisfaction of the
Ontario Building Code and the Thunder Bay District Health Unit.
3. The use of peat-based biofiltration sewage systems to treat and
dispose of domestic wastewater is now required.
4. Sewage systems are to be located downgradient of the wells, to
minimize the risk of impact on the groundwater aquifer.
5. Owners agree to prepare all lots by leveling and importing
suitable fill to construct a subsurface sewage disposal system to the
satisfaction of the Thunder Bay District Health Unit.
Ontario Drinking Water Standard
1. Fluoride levels observed in test wells were above the
Ontario Drinking Water Standard (ODWS) and purchasers are advised that
treatment is required to meet the ODWS of 1.5 mg per litre.
2. Deep drilled wells will be necessary and treatment may be
required to reduce the aesthetic water quality parameters or iron
and manganese.
3. Groundwater sodium levels may exceed the 20 mg per litre
"level of concern" for people on sodium-reduced diets.
4. All information on fluoride and sodium levels collected from
the wells should be forwarded to the Medical Officer of Health so that
local physicians can be informed.
Requirements before Grading or
Construction
The condominium agreement between the owner and the municipality
shall contain the following provisions, with wording acceptable to both
the municipality, MNR, the Thunder Bay District Health Unit, and the
LRCA wherein the owner agrees:
1. Before commencing any grading or construction on any unit
(lot), the owner agrees to prepare a detailed report, drawings, and site
plans acceptable to both the municipality, MNR, the Health Unit, and the
LRCA which will show:
a) the location of all building and structures to be
erected on the site, and all final grades and vegetation; and
b) the means whereby storm drainage will be accommodated,
and the means whereby erosion and siltation will be contained and
minimized, both during and after the construction period.
2. To erect snow fencing or other suitable barriers prior to
initiating and grading or construction on the site, to prevent the
unauthorized dumping of fill and to keep these barriers in place until
all grading and construction on abutting lots and roadways has been
completed to the satisfaction of both the municipality and the MNR /
Conservation Authority.
The condominium agreement between the owner and the
municipality shall provide to the satisfaction of the Ministry of
Natural Resources a notice to prospective purchasers of all lots, that:
No shoreline alterations, dock construction, break waters, submerged
waterline, or any other water related work shall be undertaken without
the authority of a Work Permit obtained by the Ministry of Natural
Resources. Depending on the nature of the work, a work permit may
not be issued.
A condition for final approval by the Minister of Municipal Affairs and
Housing is that the condominium agreement between the owner and
municipality contain the following provisions:
1. Water from Lake Superior should be adequately filtered
and disinfected prior to being used for human consumption and domestic
purposes.
2. No fill should be placed or removed, nor any existing
vegetation should be altered within the setback areas for each unit
(lot) without consultation with the Ministry of Natural Resources.
3. Approvals from the Federal Department of Fisheries and
Oceans may be required for an projects in and around water.

Property Manager
A Property Manager has been hired and the property owners have
elected a Board of Directors.
Initially the duties of the Board of Directors and the Property Manager
will be to arrange for the road maintenance, to supervise new
construction and to ensure that it adheres to the Development
Guidelines, and to arrange for garbage collection, etc.
